TERMS OF SERVICE AND ACCEPTABLE USE POLICIES

This Services Agreement (the "Agreement") contains the complete terms and conditions which govern your subscription of Web hosting and other Internet-related services provided by MYEASYPICS.com, (the "Services"). As used in this Agreement, the terms "We", "us", "our", and "MYEASYPICS.com" mean MYEASYPICS.com the service, and "Client", "customer", "you", and "your" mean you. As referred to in this Agreement, "Site" refers to a World Wide Web site and "MYEASYPICS.com Site" refers to the Site located at the URL http://www.MYEASYPICS.com, or any other successor Sites owned or maintained by MYEASYPICS.com.

By clicking on the "SIGN UP" button on this site, you acknowledge that you have read this Agreement, and you agree to its terms and conditions and all policies posted on the MYEASYPICS.com site.

PROHIBITED CONTENT:
- NO adult content. Nude sexually oriented images are prohibited!
- NO copyright infringement. You must have legal authority over your images.

FREE TRIAL POLICY:

- We do not allow repeat free trials. Repeat free trial accounts are an abuse of our service and will be deleted without notice.

- Duration of free trial is limited to 10 days OR 1000mb of bandwidth usage, whichever comes first. When a free trial account reaches either of those limitations it is automatically de-activated and images will stop displaying.

- You have the option to upgrade your free trial to a higher plan paid subscription at any time during the 10 day trial period. Subscriptions require a PayPal account, as all of our subscriptions are handled automatically by PayPal. Contact us to upgrade.

GUARANTEES:

While MyEasyPics.com has an impeccable track record of uptime, speed, and service, we must set reasonable limitations on our guarantee of service. If the rare occasion occurs that our network or equipment experiences a downtime issue that lasts more than 15 minutes in a single 24 hour period, each client is entitled to a refund equal to one (1) day's worth of their hosting plan price during that 24 hour period based on the Client's hosting plan, and such refund will be provided at the request of the Client.

We guarantee you:
- High standards in customer service - polite, professional, same-day direct replies to your queries.
- 99.9% annual uptime - meaning that we allow ourselves less than 9 hours per year of downtime for server/software upgrades and technical problems.

Pursuant to sections 6 and 7 below, MyEasyPics.com will not be held liable for any data loss or loss of revenues, nor any other expenses or damages incurred by the Client in the event of network problems, software problems, or equipment failures.

We guarantee your satisfaction with our service and our customer relations by way of welcoming you to take our free trial offer with no obligations, and welcoming you to contact our customer service department with your questions.

If at any time you do not feel that we are living up to our guarantees, please do feel free to contact us with your concerns and always know that you have the ability to cancel your service with us instantly at any time.

CANCELLATION / TERMINATION:
Client may instantly terminate (cancel) their hosting subscription easily at any time by following these 3 simple steps:
Step 1. Log in to your MyEasyPics.com account and click ACCOUNT/PREFERENCES button.
Step 2. Scroll to bottom of page and click UNSUBSCRIBE button.
Step 3. On the PayPal page this action brings you to, make sure you CONFIRM the cancellation of the subscription with PayPal.

Cancellation / termination immediately de-activates all image hosting on the terminated / cancelled account.

If a Client has difficulty with the automated cancellation / termination process - Client should contact us and ask us to terminate / cancel their hosting subscription. All cancellation requests are honored within 24 hours.

MYEASYPICS.com provides the Services exclusively and makes no effort to edit, control, monitor or restrict the content of data other than as necessary to provide such Services.

• Client Content. Client agrees that it will not distribute, electronically transmit or display any materials supplied by Client - or through Client by a third party - to any MYEASYPICS.com server in connection with Client's use of the Services which:
  • Containt nude sexually oriented images;
  • Violate any state, federal or foreign laws or regulations;
  • Infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights) of MYEASYPICS.com or any third party;
  • Are defamatory, slanderous or trade libelous;
  • are threatening or harassing;
  • are discriminatory based on gender, race, age or promotes hate;
  • violate any MYEASYPICS.com policy posted on the MYEASYPICS.com Site.
  • contain viruses or other computer programming defects which result in damage to MYEASYPICS.com or any third party.
  
  
• Bandwidth. Client may occupy only the amount of disk space on the MYEASYPICS.com Server and utilize no more than the network bandwidth that is allotted by MYEASYPICS.com according to the hosting plan that Client has purchased. When Client's account approaches the bandwidth limit defined in the particular hosting plan that Client purchased, Client will have the option to upgrade to a hosting plan that provides more bandwidth.



• Termination. MYEASYPICS.com reserves the right to refuse service to anyone. MYEASYPICS.com, in its sole discretion, may immediately terminate this Agreement if Client engages in any of the prohibited activity outlined in this agreement. To report any unacceptable behavior by a third party using the Services, please contact us.



• Back-Up Files. MYEASYPICS.com does back-up server files regularly; however, MYEASYPICS.com does not guarantee the existence, accuracy, or regularity of its backup services and, therefore, Client is responsible for making back-up files in connection with its use of the Services. 

• Service Fees. Client must make payments for services in a prompt and timely fashion. Clients with monthly billed hosting plans must make their monthly payments no further than 30 days apart. MYEASYPICS.com shall be entitled to immediately terminate this Agreement (and Client's hosting account) for Client's failure to make timely payments to MYEASYPICS.com. Because all Services and hosting plans are provided on a monthly basis, Client will be responsible for Service fees for the current month regardless of which date Client provides notice of termination. Thus, for example, if Client provides notice to terminate on the 15th of a particular month, Client will still owe fees for the entire month and such fees will not be pro-rated or refunded. If Client has retained the Services for one (1) year and has pre-paid MYEASYPICS.com for such Services, refunds will be issued for any unused full month portions Services upon Clients request.

• The parties agree that in no event shall MYEASYPICS.com be liable to any third party for Client's breach or alleged breach of any of the terms and conditions set forth in this Agreement. Client agrees to defend, indemnify and hold harmless MYEASYPICS.com from any and all expenses, losses, liabilities, damages or third party claims resulting from Client's breach or alleged breach of any Client obligations set forth hereunder.

• Subject to the terms and conditions hereof, this Agreement shall be effective on the date you subscribe to our Services, and shall continue in effect on a month-to-month basis unless otherwise specified by separate agreement (the "Term") unless terminated earlier pursuant to the provisions of this Section 4. Either party will have the right to terminate this Agreement upon notice to the other party.

  If a Client has difficulty with the cancellation / termination process, Client must contact us and specifically state that they wish to terminate / cancel their hosting subscription. All cancellation requests are honored within 24 hours.

• If Client terminates its account, Client shall be allowed to re-instate their use of the Services at any time they wish, however Client's original images are only stored on our server for 7 days after a subscription cancellation / notice of termination.
  
  Re-instatement / Re-activation - Once payment has been received for re-activation of a subscription that a Client has cancelled, Client's account will be activated within 24 business hours.

• Client will pay and indemnify and hold MYEASYPICS.com harmless from any and all taxes associated with or arising from Client's use of the Services, including any penalties and interest and any costs associated with the collection or withholding thereof.

• THE SERVICES, THE MYEASYPICS.COM SITE, INCLUDING WITHOUT LIMITATION, ALL PRODUCTS AND SERVICES DISPLAYED OR OFFERED ON THE MYEASYPICS.COM SITE, AND ALL TEXT, GRAPHICS, LINKS AND APPLICATIONS ARE PROVIDED TO CLIENT ON AN 'AS IS' BASIS AND WITHOUT WARRANTY OF ANY KIND. MYEASYPICS.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EACH OF THE FOREGOING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM A COURSE OF DEALING. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, MYEASYPICS.COM SPECIFICALLY DISCLAIMS ANY WARRANTY THAT (1)THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (2) DEFECTS WILL BE CORRECTED; (3) THERE ARE NO VIRUSES OR OTHER HARMFUL COMPONENTS; AND (4) THE SECURITY METHODS EMPLOYED WILL BE SUFFICIENT.

• IN NO EVENT SHALL MYEASYPICS.COM BE LIABLE FOR DAMAGES RESULTING FROM LOSS OF DATA, PROFITS, USE OF THE MYEASYPICS.COM SITE OR ANY MYEASYPICS.COM PRODUCTS OR SERVICES, OR FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER.

• If any of the provisions, or portions thereof, of this Agreement are found to be invalid under any applicable statute or rule of law, then, that provision notwithstanding, this Agreement shall remain in full force and effect and such provision or portion thereof shall be deemed omitted. This Agreement (including the Exhibits, attachments and/or addenda, if any,) represents the entire agreement of the parties with respect of the subject matter hereof and supersedes all prior and/or contemporaneous agreements or understandings, written or oral between the parties with respect to the subject matter hereof. This Agreement and the rights granted and obligations undertaken hereunder may not be transferred, assigned or delegated in any manner by Client, but may be so transferred, assigned or delegated by MYEASYPICS.com. Any waiver or any provision of this Agreement, or a delay by any party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor create an expectation of non-enforcement of that or any other provision or right. In any legal proceeding between the parties under this Agreement, the prevailing party shall be entitled to recover its costs, expenses and reasonable attorneys' fees. This Agreement is made under and shall be governed by the laws of the United States of America, except with regard to it's conflict of law rules.

  This Agreement and MYEASYPICS.com's policies are subject to change by MYEASYPICS.com at any time, therefore it is important that you check this page frequently for changes.
